1. Agreement to Terms

By accessing and using MimzSubvert's eco-tourism services in Romania, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services. These terms apply to all visitors, users, and others who access or use our nature conservation tours and related services.

MimzSubvert reserves the right to modify these terms at any time without prior notice. Your continued use of our services following the posting of changes constitutes acceptance of those changes. We encourage you to review these terms periodically to stay informed about our policies.

2. Service Description

MimzSubvert provides sustainable eco-tourism experiences in Romania, including but not limited to:

• Guided wildlife photography tours in the Carpathian Mountains
• Conservation volunteer programs and environmental education
• Mountain hiking expeditions with certified guides
• Botanical discovery tours and sustainable nature experiences
• Cultural heritage tours combined with nature conservation activities

All tours are subject to weather conditions, seasonal availability, and local regulations. We reserve the right to modify itineraries or cancel tours for safety reasons or circumstances beyond our control.

3. Booking and Payment Terms

Reservations: All bookings must be made through our official website or authorized partners. A deposit of 30% is required to confirm your reservation, with the balance due 30 days before your tour departure date.

Payment Methods: We accept major credit cards, bank transfers, and approved online payment systems. All prices are quoted in EUR and include applicable taxes unless otherwise specified.

Group Bookings: Special rates apply for groups of 8 or more participants. Corporate and educational group discounts are available upon request with appropriate documentation.

4. Cancellation and Refund Policy

Customer Cancellations:

• More than 60 days before departure: 90% refund of total cost
• 30-60 days before departure: 75% refund of total cost
• 15-29 days before departure: 50% refund of total cost
• Less than 15 days before departure: No refund available

MimzSubvert Cancellations: If we must cancel a tour due to weather, safety concerns, or insufficient enrollment, we will provide a full refund or credit toward future tours. We are not responsible for additional expenses incurred such as flights or accommodation.

Refunds will be processed within 14 business days of cancellation confirmation.

5. Participant Responsibilities

Health and Fitness: Participants must be in good physical condition appropriate for outdoor activities in mountainous terrain. We require disclosure of any medical conditions that might affect your ability to participate safely.

Equipment and Preparation: Participants are responsible for bringing appropriate clothing and personal equipment as specified in our pre-trip information. We provide detailed packing lists and equipment recommendations.

Conduct: Participants must follow all instructions from guides, respect local customs and environment, and maintain behavior consistent with our conservation mission. Disruptive behavior may result in removal from the tour without refund.

Environmental Responsibility: All participants must adhere to Leave No Trace principles and our sustainability guidelines during tours.

6. Safety and Liability

Assumption of Risk: Outdoor activities involve inherent risks including but not limited to wildlife encounters, weather conditions, rough terrain, and remote locations. Participants acknowledge these risks and participate at their own discretion.

Insurance: We strongly recommend comprehensive travel and medical insurance. MimzSubvert maintains professional liability insurance but participants are responsible for their own medical and evacuation coverage.

Emergency Procedures: Our guides are trained in wilderness first aid and emergency protocols. However, medical facilities may be distant in remote areas, and evacuation may be delayed by weather or terrain conditions.

Limitation of Liability: MimzSubvert's liability is limited to the cost of the tour. We are not responsible for injuries, damages, delays, or losses arising from circumstances beyond our control.

7. Intellectual Property

All content on our website, including text, images, logos, and tour materials, is protected by copyright and trademark laws. Participants may not reproduce, distribute, or commercially use our materials without written permission.

Photography Rights: MimzSubvert may take photographs and videos during tours for promotional purposes. By participating, you grant us permission to use your likeness in our marketing materials. Please inform us if you prefer not to be photographed.

Participant Content: Any reviews, photos, or content you share about your experience may be used by MimzSubvert for promotional purposes unless you explicitly request otherwise.

8. Privacy and Data Protection

We are committed to protecting your privacy and comply with applicable data protection regulations including GDPR. Personal information collected during booking and participation is used solely for tour operation and communication purposes.

9. Force Majeure

MimzSubvert is not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, government actions, strikes, or pandemic-related restrictions.

In such cases, we will make reasonable efforts to provide alternative arrangements or future credits, but cannot guarantee refunds for circumstances beyond our control.

10. Governing Law and Disputes

These terms are governed by Romanian law and any disputes will be subject to the jurisdiction of Romanian courts. We encourage resolution of any concerns through direct communication with our customer service team.

Any disputes that cannot be resolved amicably will be settled through binding arbitration in Brașov, Romania, conducted in English or Romanian as mutually agreed.
